Terms and Conditions

Agreement

These terms apply when you request an offer from, sell supplies to, or otherwise do business with Texas Medical Supplies (“we,” “us,” or “our”). By requesting an offer or sending us supplies, you agree to these terms. If you don’t agree with them, please don’t submit a request.

What We Buy

We purchase only supplies that are:

• Factory-sealed and unopened, in undamaged packaging
• Unexpired — 7 or more months of remaining dating earns our top price, and shorter dating may still qualify at a reduced offer
• Owned by you, with the right to sell them

We cannot purchase supplies obtained through Medicare, Medicaid, or any other government program. We also cannot purchase opened or damaged packaging, expired supplies, or boxes marked “not for resale” or with removed or defaced labels.

We may decline any item for any lawful reason.

Your Representations

By requesting an offer or sending us supplies, you represent and warrant that:

• You are at least 18 years old
• You own the supplies and have the legal right to sell them
• The supplies were not obtained through Medicare, Medicaid, or any other government program
• The supplies are factory-sealed, unexpired, and stored as directed on the packaging
• The information and photos you provide are accurate and describe the actual items you are selling

Offers

Requesting an offer does not obligate either of us to anything. Any offer we provide is an estimate based on the information and photos you give us, and is not binding until we inspect the actual supplies and both parties confirm the transaction.

Offers are valid for the period stated when we send them. If the items we receive differ from your description — different quantity, shorter dating, damaged packaging, broken seals — we will contact you with a revised offer before proceeding. You are free to decline it.

Local Meetups

Local transactions take place at a public location agreed by both parties. We inspect the supplies at the meetup, and payment is made once both parties confirm the sale. Either party may decline the transaction at the meetup.

Mail-In Transactions

If you choose to mail supplies to us, you are responsible for packing them so they arrive undamaged. We provide a prepaid shipping label at no cost to you.

Risk of loss and title remain with you until we receive the package, complete inspection, and both parties confirm the sale. We are not responsible for packages lost, delayed, or damaged in transit by the carrier.

If we send a revised offer after inspection and you decline it, we will return your supplies to you at our expense. If we cannot reach you within a reasonable period after attempting contact using the information you provided, we will make further attempts before taking any other action.

Payment

Payment is made after inspection and confirmation, using one of the methods we offer (cash for local meetups; Zelle, Apple Pay, Cash App, or PayPal otherwise). You are responsible for providing accurate payment details and for any taxes that may apply to you as a result of the sale.

Verification and Documentation

We may request identification, proof of purchase, or a written confirmation of ownership and eligibility before completing a transaction. We may decline any transaction where eligibility cannot be reasonably established.

We Are Not a Healthcare Provider

Texas Medical Supplies buys supplies. We do not provide medical advice, medical services, or products for medical use, and nothing on this website is medical advice. Do not send us medical records, prescriptions, insurance information, or details about your medical care. Always consult your own healthcare provider about your treatment.

Website Use

You agree not to misuse this website, submit false or misleading information, or upload unlawful or harmful content. Website content, including prices, is provided for general information and may change at any time without notice. Listed prices are maximums and are not guaranteed for any particular transaction.

Disclaimers and Limitation of Liability

This website and our services are provided “as is” without warranties of any kind, express or implied, to the fullest extent permitted by law.

To the fullest extent permitted by law, our total liability arising out of any transaction is limited to the amount we agreed to pay you for the supplies in that transaction, and we are not liable for indirect, incidental, special, or consequential damages.

Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses arising out of a breach of your representations above, including any claim that supplies you sold us were not yours to sell or were obtained through a government program.

Governing Law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be resolved in the courts located in Texas.

Changes to These Terms

We may update these terms from time to time. The “Last updated” date above reflects the most recent revision. Continued use of this website after changes means you accept the updated terms.
